Query related to under construction NOCs
There is a project with high rise towers located near Horamavu Lake in Bangalore. From Jakkur Aerodrome project is within 10 km of radius, while from Yelahanka Air Force Station within 15 km of radius. As per my research, first requires AAI NOC, while 2nd may require HAL NOC; but not sure.
#) Found that few of the NOCs are expired. AAI for height clearance was valid for 5 years from Oct-2008, and also mentioned to take fresh NOC if building is not constructed/completed in that period.
#) Also latest CC of Jan-2017, It is mentioned to have HAL NOC for above 4th floor construction. But No separate HAL NOC is provided. Expired AAI NOC is shown over for that.
#) Owner/Developer will have exclusive right on common garden/terrace attached to ground floor apartments and he can sell it in future!
Based on above mentioned situation, please let me know following
1) Will be good to proceed ignoring above mentioned points?
2) Expired NOCs (especially AAI) can be considered during under construction work?
3) HAL NOC mentioned in CC is not required and AAI NOC can be considered instead of that?
4) Selling of mentioned common area, will not affect UDS? Shouldn't it to be owned by Association in future?
