Regarding not receiving revealing and experience letter.
Company where i use to work was continuously reducing my salary and hence i wanted to resign but mgmt. wanted to terminate me rather then to accept my resignation. In between, I quit going to office for around 3 weeks and HR department sent me a abscond letter and hence i rejoined again. I received the remaining 1 week salary, continued to work for two more months and finally resigned (via email and served notice period). Its been 1 month and my final settlement is pending. I am not impatient for the formalities like experience letters and others as it takes time but i have doubt on my companies intention.
MY questions are as follows:
-How much time does an organization can take to finish the formalities? Is this legal?
-I am very much concerned about my revealing letter and experience certificate and doubtful about company intentions. May i ask , if they mention any negative comment, will this be lawful can i take action against it (as company is willing to do that).
-I have not received my previous 8 months salary slip, how will i cross check the gratuity amount and PF amount given by company is correct.
-Company has done the same with previous employees (Terminated and mentioned performance issue in experience letter) hence i am concerned. (In this company either you work or you will be terminated and get your future in trouble).
Things that may go against me:
-I have not submitted my company ID on my last working day, HR said it will take time to release the letters and i assured, i will submit my ID on the same day when i come to collect letters and final settlement.
-Around 6 to 8 months before, company issued performance warning letter but mgmt. let me continue after that.
-I have received abscond letter (as mentioned earlier) from HR but have continued after that. Received salaries continuously.
-No proof that company has accepted my resignation. (No resignation acceptation mail, no separation mail).
After one week from resignation, i sent an email to HR to inquire regarding the formalities to be completed and demanded for salary slips but no reply till date.
Its been 8.8 years i am working with the organization, its a trading firm where payoff is shared between employer and employee. currently i have made losses in the market (its not illegal as its a part of work) however its clearly mentioned in our offer letter that employees are not liable to pay against any trading (work) related losses.
