Consumer dispute with builder
Sir my name is Anoop Kumar and I am from Nagpur in Maharashtra. I had purchased two row housed in the year 2005 and 2008 respectively. The one purchased in 2005 is with a registered agreement to sell and the later one is notorised agreement. The builder suddenly stopped the work and vanished. But since there local partners of the builder company I filed a consumer complaint to which relief was given to me in the year 2010. The order said that the builders will either have to pay the sum equivalent to the prevailing price in 2009 or complete the incomplete property and complete the sale deed. Later we filed an execution case before the forum which is running till date and in finalization stage.
Meanwhile on my last visit to the site we found that another builder has taken over the scheme and started completing the incomplete row houses. I found that he has commenced work in one of the row houses that was supposed to be mine. The fact was brought into the builder's notice. He informed us the row houses were financed by Punjab National Bank and Allahabad Bank. We showed him our documents and to our surprise we were shown a layout map which did not tally with ours and therefore now the house which was numbered 41 in our agreement was 38 in their document and though the banks had committed a fraud yet they had the guts to sell the property to third person. Now I am in dilemma as to what is the course of action left for me.
If I wait till the court completes execution proceedings-the new builder will complete the row house and sell to another person thereby further complicating my case.
I have paid 100% amount for one row house and approximately 75% for the second row house. I am a senior citizen.
