Survey No. 1. Land available 2.17 acre
Survey No. 2. Land available 7.32 acre
Survey No. 3. Land available 1.11 acre
Survey No. 4. Land available 3.01 acre
Survey No. 5. Land available 1.23 acre
Transactions executed by vendor Mr. Kareem (Owner of all land in all survey numbers) The details are:
1. Year-2001-Gift deed executed by vendor Kareem in favour of his daughter from Survey No:1 for 1 Acre
2. Year-2002-Sale and GPA executed in favour of Mohan for 8 Acre and 2 Guntas.
As per Mohan’s sale deed how much land from each survey number breakdown is NOT available.
Under RTI Act of 2005 asked to provide breakdown information, how much land sold to Mohan from each survey number. Registration office replied saying breakdown per survey number is not available and in support provided a certified copy of sale deed.
3. Year 2005 Three sale deed executed in favour of X Y and Z by vendor for 400SQY and 2400SQY(20Guntas)and another 400SQY respectively. All these transaction mentioned clearly indicate land belongs to survey number 1. 4. Total transaction in Survey No.1 are (1 Acre +SQY 3200 (400+2400+400)
5. Year 2006 daughter of vendor transferred her gifted 1 Acre land to Mohan
6. Year 2008 Mohan executed sale deed in favour of Ajay 8 Acre and Guntas 2(From Survey No: 1, 2, 3, 4 and 5) As per Ajay’s sale deed also not showing how much land from each survey number (breakdown of total land per survey is NOT available.
7. Year 2008 Ajay same week of his original transaction executed a sales deed in favour of Rahim to the extent of 20 Guntas (Rahim is son of Kareem original vendor)
Online EC is showing all the transactions.
April 2016 an EC was obtained by XYZ which is satisfactory. But physically unable to identified the plots and vendor is not cooperating saying land ceiling issues etc.
Our question is:
A) Under RTI Act can we ask to Mandal Revenue office to provide a physical Survey report of Survey No. 1 who are in possession and what other information we can ask to Registrar or Mandal Revenue Officer
B) As per the above transactions Mohan still owns one Acre land transferred from vendor’s daughter and why Ajay transfer same week to Rahim (kareem’s son) 20 guntas of land This transaction seems suspicious
C) Is not an utter negligence and lack of duty of care on part of sub registrar in reviewing sale deed? Why breakdown of Acre 8 and 2 Guntas per survey number not mentioned in sale deed both transactions
D) Advice on how to proceed for possession.
E) What is the approximate cost of legal case and how long it takes?
F) XYZ are NRI’s. We are concern with Survey No. 14
