Husband retirement benefits , unpaid salaries
My husband retired from a cooperative institute last year. He passed away one month after his retirement. His employer where he served for more than 30 yrs. did not provide any details about his retirement benefits, outstanding monies at time of retirement. He was not getting salary also from some time due to poor economic situation of his institute. He was MD of the institute. Due to poor economic situation of this institute, He was not taking salary but he ensured all people working under him are getting paid. After his death i submitted several letter to his employer, his employer released gratuity partially to me last year but never replied to my letters. Through my letters i requested the employer to provide details of my husband outstanding monies and release them at the earliest.
Finally after 6 months of my husband death, the employer has replied to my letter and informed me that:
- There is shortage in GPF and gratuity of all employees including my husband and therefore only amount on prorate can be released. No details have been provided on amount. Employer mentioned that my husband was MD and therefore he is responsible for this shortage.
- On outstanding salaries they informed that it will be paid when economic situation improve. No details provided
- Employer also informed that there are certain internal enquiries pending to his tenure as MD and therefore outstanding monies will not be released till the time all enquiries are not settled. No details of inquiry provided by employer.
Please suggest what are the remedies available as per law.
