civil case landlord vs tenant
Hi, i filed a civil case against my tenant i.e. for shop in march 2009 and tis hazari court passed the judgment in my favour in sep 2013..i filed a case in bonafide need. Then after completing six months the tenant had to vacate the shop but on last day of six months i.e. on 27th march 2014 he went to high court with the and in july 2014, high court dismiss the case with granted him the time till dec 2014 to vacate the premised and told him to file an undertaking that he will vacate the shop in dec 2014..but when I check the judgment online the granting time was dec 2015...then I went to high court for clarification of date..then I got the info from online judgment that the tenant had not filed the undertaking and then I appeal in tis hazari court for issue of warrant and in nov 2014 I got the shop...the tenant filed a undertaking on 3rd nov 2014 whereas the last date of filing undertaking was 10th aug 2014. high court denied his undertaking and dismiss the case with the below judgement.
After arguments, these applications are disposed of with the
consent order that petitioner will receive a sum of Rs.40,000/- from the
respondent/landlord within a period of four weeks from today, and which
will settle all the disputes as found in the present applications. This
order is passed because respondent/landlord has taken possession of the
suit premises in execution of the judgment and decree and therefore the
date of eviction whether it was of 31.12.2014 or 31.12.2015 has become
immaterial.

my question is...can I sell my shop now as its in very bad condition as I got this shop after 40 years....and I donot have enough money to repair it...
