U/s.26 Order 7 Rules 1 to 6 of CPC..Relating Partition suit
Dear Sir/Madam
I am the Respondent i have a Partition deed (Unregistered) executed between my father and My paternal uncle in 2004 for the properties of his father. Without consent of the other legal hairs called elder sisters. My father and my paternal uncle got the Title deed and Passbook for the Properties and house taxes too in 2004.
Here now in 2016 My paternal uncle was passed away he is Unmarried wrote the will in favor of me
My paternal aunt field the partition suit on my paternal uncle ancestral properties for the allotting the share in the property
Dear Sir/Madam i want to ask some clarifications for my doubts
In 2004 My father and my paternal uncle divided ancestral properties through unregistered partition deed without consent of other legal hairs(all are elder sisters 3 members)
1.The unregistered partition deed have any validity or not(executed in 2004)
2. in-case it's not valid how the Revenue department gave the Title deed and passbook for the ancestral properties
3. Is there any time period for the validation of unregistered partition
4. My paternal uncle wrote the will in favor of me. Is there any validity of the WILL(unregistered)
5.What are the documents require to get the decree in favor me
6.Is there any chance my paternal aunt(plaintiff) to get decree
I kindly request you to please help me for the facing the suit.....
