Transfer order with change in designation / Lower rank
Dear Sir,
I had lodged a complaint before Asstt.Labour commissioner of my harassment and insult by company manager , Labour commissioner issued notice to the employer to put their stand, contrary on receiving legal notice from labour office , same day my employer acted retaliatory and subjected me to transfer order with mentioning change in designation / Lower rank and stated your services has been transferred to such city as a lower rank mentioned.
I did not comply to said malice / punishment transfer order and challenged the same in the court and proceedings are going on.
Moreover from day one I am asking my employer this order is malice and clarify me your stand how and under which law my designation is changed to lower rank, but employer is totally silence and not replying to any of my representations .
Even I asked them to clarify how can I work on lower rank/ designation and you please clarify under which grade / rank is will work at new place. But employer is totally dormant and silent not replying to any of my letters .
In transfer order employer wrote like to me that you services are being transferred w.e.f from [deleted] from city A to City B as a lower division clerk ( where as currently I was working as upper division clerk) .Means designation is lowered and on asking them to clarify such the employer is totall silent and not responding at all.
The designation mentioned in transfer order is lower and there is difference in DA and daily allowance and other monthly emoluments between my current designation and designation mentioned on transfer order.
Is this clear case of malice to prove before the court and can I lodge another case before the court under section 9-A of changing service condtions without serving any notice of change against the employer.
