Termination without Notice and clearing our dues(salary & PF)
Respected Lawyers,
I would like to inform you that I am working in iYogi technical service Pvt. Ltd. from 19th March 2012. On 11 Nov 2016 one of HR person come and told to all the employees (around 150) that company has closed this Noida side and you all have to give your resignation. We all were not agree to gave resign because no one on behalf of the company will inform us previously or gave any notice in this regard. On 14 Nov 2016 Company itself terminate and raise our resignation and told that 14 Nov was consider as our last working day in that company.
Company not paid our salary for last 8 months (April to Nov) and also not submit our PF from last 15 Months (Aug 2015 to Oct 2016).
My questions are:
1. Can we do anything in these regard : "Termination without paying notice and clear our dues like salary and PF and Gratuity "?
2. What we can do if company not submit our PF amount however the PF amount deducted from our salary every month ?
3. Please tell me the procedure who can we fight against the company for our hard earn money ?
4. What can we do if company shows bankruptcy ?
5. Please tell me what are the legal charges we can put on company if we file a case in court ?
