Getting a stay order.
My paternal uncle had a land, since he had no heir, he wished (no written will) that the piece be equally shared between his 3 nephews (including my father) and a niece (there are 2 nieces, 1 is unmarried and has always been very partial to my father and favoured the other 2 uncles, however she was not the part of this wish). This aunty started harassing my father so that he could leave his share, my father succumbed to it and gave up his share hoping that at least she would stop harassing him, now the remaining 2 uncles and aunty contributed and constructed a building, each one sharing a floor.
A year has passed and this aunty of mine still for no reason would not leave any opportunity to harass my father. My father and mother both are heart patient (undergone open heart surgery). Now this is beyond my tolerance.
Now can my father still claim his right on that property and can he get a stay order as he was denied his share?
Note: My paternal uncles wish or my father’s giving up of his share nothing absolutely nothing is on papers. Everything is verbal.
