The building was sold two times & dispute is on possesion .
It is about a land dispute of my father and your advice on this matter will be highly valuable.
my father bought residential building on 19/12/15 from Mr. sonu who was in debt and since he couldn’t pay the dept,the building was a debt recovery asset of bank.
A bank recovery agent told sonu that his house will not be auctioned if he pays the debt through him.
So my father gave the money to the recovery agent and sonu and all of the paper work(including the original papers of the building and the original) was done .
but on 2/01/2016 my father was informed that the bank has auctioned the building to Mr.Rajput in Aug-2015.
but the key points here are-
• the registry of the the building by Mr Rajput was done on 31/12/2015 where as the registry by my father was done on 19/12/2015.
• the bank didn’t placed any notice at the building prior to auctioning and neither after the auctioning.
• the original papers of the building are with my father.
• whereas Mr. Rajput has filed a complaint of lost of the original papers on 05/01/2016 that the papers were lost on 04/01/2016 .
• full cash payment was given to the recovery agent but the bank doesn’t recognizes him and he denies of it.
• the suspicion wasn’t there earlier bcoz he had the building’s original papers.
• main accused is the recovery agent.but Mr. Rajput is also suspected to be along him because he neither paid the full payment to the bank ,he only gave the token money after auctioning and made full payment after 5 months i.e. in jan-2016 when my father had already bought the building and the registry was already done .
• but the place where we lag was that the notice for the debt recovery was accepted by sonu’s mother who is illiterate.
• thus sir please give some assistance on this matter as we have talked to some advisers but legal procedure has already taken a lot of time.
