Cancellation of visar pavati

I made visar pavati with owner and came into agreement to buy a duplex flat. Duration to complete the transaction was 6 months which is mentioned in the agreement. But after agreement he never cooperated me about any property documents to which he was agreed in contract to fulfill, also he was agreed to fulfill all the dues of society but he never and most important after agreement i found that there is a loan on the flat from hdfc and actually he told me that there is no loan on flat which is also mentioned in the agreement. It is also mentioned that if any loan or litigation found on property he will solve it by his own money. now he issued a notice and wants to cancel the deed saying i was not able to complete transaction in 6 months and returning my money which i gave him as a downpayment. But i want interest on my money and also the expenses i made on flat which he is denying but my view is due to his fault my loan could not be disbursed from sbi and also he cheated me saying there is no loan on property. There is no any clause of cancellation of deed. Please give me opinion, what should i do, should i go to court or just get back my money
