Legal advise
We A,B,C,D bought 5.7 acres of land by 1992.
Now A is father of other three and expired by 2014.
He left a reg.will mentioning that his share i.e. 1.425 acres has to be divided and given to B and another brother E who is eldest.
B,c,d has decided to sell the property and made sale agrement with a party X for 4.9825 acres of undivided land. This has been vocally informed to E that his share can be subdivided by 5th of Dec 2016. Agreed by then and after 20days he is creating problem with us brothers and to the buyer who has given possesion. My questions are as below.
1.He is not willing to come for subdivision that he wants thasildar to come and do the partition.
How to deal the above?
2. Can he go for injection against the sale agreement since the major portion is with b,c,d. ?
3. In what way he can file any complaint on the buyer and how to tacle without litigation?.
4. The land has a well that will goes to the buyer share, has any issues?
Pls I need your advise and suggestions.
