Booking Application for Flat

I, alongwith my wife (as co-applicant) booked the flat in under construction scheme. We both signed the front side of the Booking Application where no conditions were written. On back side of the Booking Form only my signatures were obtained by the builder my wife didn't sign there. Total one lac payment was made 89,000 by cheque issued by my wife and 11,000 by cash (receipts are available). There was a condition that builder shall provide all documents showing permissions etc. to the buyer. There was another condition that Booking amount shall be forfeited in case buyer doesnt pay the amount within 30 days. Builder never provided me any documents till date after 3 months. I sent email to builder after 5 days from signing Booking Application, and demanded relevant documents from the builder which he replied and said that same will be done ASAP. I also mentioned in same email that I shall not enter any agreement and will not pay any further amount and seek refund, if no documents were supplied or if I find documents suspicious. Now builder is not refunding my money.. whether my case is on solid footing if I approach Consumer Forum
