• Opponent filing petty cases to harass us

We are having a land boundary dispute with the neighboring land owner. Once he came with the surveyor to measure and lay demarcation stone. We allowed to measure the land, but did not allow to lay demarcation stone since it falls into our boundary we possess for the last 21 years.
Now the with the help of local police he is trying to force us to go for a compromise. We have the correct measurement in our sale deed as well as in EC. He has the Resurvey plan, according to which he is trying to grab our land.
The police is threatening that they will file FIR for not allowing the govt. servent to work.
Also the opposite land owner is filing petty charges like we are stealing his cocunut, we are not allowing him to visit the land etc.

I had raised a police complaint through online. But didn't get any reply.

What should I do?

This happens in our native place where my mother alone leaves. There are few relatives near by.
I am living some 1000 away. Is there anything I can do?

You should permit demarcation of land

2) if you are dissatisfied with demarcation you can take legal proceedings to. Challenge the demarcation done

3) police can file FIRif you obstruct govt servant in performance of his duty

It seems that police has been bribed by the complainant. You may move the High Court against police to restrain it from harassing you in any manner. This apart, also file a caveat to preempt your neighbour filing any lawsuit for injunction and walking away with favourable orders without summons reaching your door.

Do not allow him to put any stone.

If you want permanent solution then file a suit for declaration of area of land and injunction against disturbance till the court gives a final decision.

1. Both the properties have been well specified in their respective title deeds which have been registered and can be measured and demarcated by Govt. Surveyor.

2. First be sure whether you bare holding his land as your land for last 21 years or not for which your are required to get both the pieces of land surveyed.

3. If yes, file a petition before the Court claiming adverse possession of the said additional area of land and get a stay order from the Court to maintain status quo till the suit is disposed off.
