• Will probated in regional language

Hello experts

My father had a registered will which got probated recently.
As per the will one of the property in Mumbai needs to be transferred to my mother. 
The will was registered in kharagpur west Bengal in Bengali language. The probate orders are in English but the main contents are in Bengali.

My query is that will this registered will(probated) in Bengali be valid in Mumbai

Yes it will be valid, may be for better hnderstanding of language by bombay people get it translated by official translator, it will suffice

2. If a part of the judgment is in Bengali then get it translated into English from an official translator.

1. It is valid in any part of the India if is a registered Will and you have to get authenticated translation by the approved translator either in the State of West Bengal or in the State of Maharashtra.

2. Usually whenever a case is filed in a Court and when a document enclosed/annexed to the plaint/petition,a translated copy must have been filed otherwise such petition/plaint will not be accepted by the concerned court.

3. You may search for approved translated and get it translated.

1. The probated will is valid all over India.

2. It will be prudent on your part to get the said will translated by Court approved translator whom you shall find near Calcutta High Court.

3. With the said translated copy of the said will which has also been probated by the Court, you should not ace any problem in connection with the said will written in Bengali language.

WILL in regional language do not make it invalid, which also approved by the court.

Get the WILL translated in Hindi/English by authorized translator.

My query is that will this registered will(probated) in Bengali be valid in Mumbai --- Validity of court orders have higher value in all over India.

Get the Will document translated in English, you can use the same in Mumbai as well.

The judgement passed in a Probate case is considered as ' judgment in rem' which means its applicable against the whole world.

So forget the language in Will. Irrespective of language in the Will the same is binding in any part of the world.

The Will granted probate in West Bengal is valid through out the country.

You can get it translated through any court staff or a translator or by an advocate, get it notarised and produce it in Mumbai along with the copy of the original contents in Bengali.
