I have engaged a contractor to waterproof and paint the exterior walls of my mud block house. The company that is doing the painting is a sole proprietorship. The owner refused to sign a labour contract. He has promised to give me a five year service warranty for any seepage from the walls due to rain. I agreed to make the payment for the work in two instalments of 50% of the amount. The first instalment was paid today after half the work was completed. The final instalment will be paid only after receiving the warranty. Question: What should I expect from the contractor and from the warranty to ensure that it is enforceable by law and the consumer court?
The contractor has promised a warranty that the company will provide material and service free of cost for up to five years in case there is any seepage after completion of the work. What should the warranty certificate contain to ensure that I can use it in a consumer court if the contractor does not provide the service promised? As there is no agreement existing between you both, you may ask him to execute the warranty on a non judicial stamp paper duly attested by witnesses or as notary public

- However , if the warrantee of the company having the clause of maintenance for 5 years then this card must be stamped and signed by the paint company.
