Hi Sir, 
I have a question for CLAT2025 exam.. my daughter has completed 6 to 12th Grade in USA..
and Gdade 1 to 5th Grade in India.
1) She has written CLAT 2025 and applied under Indian general caterory. Not as a NRI , is this acceptable?
2) Is it Mandatory to apply under NRI category.as we are moving back to india.

You have to apply under NRI category as for last 6 years she is an NRI

  1. NRI category is privilege, any privilege can be given up by the claimant. There is no bar against it. If you are ok with general category you are eschewing your claim, no one can any objections for that.
  2. Anyway, “CLAT office will not do allotment of NRI/NRI Sponsored seats”. The only concession is, inclusion in Admission Counseling process for their other applied categories. You can avail general category.

Your are right. It is the candidate who is given right to avail the reservation in any particular category. NRI is nothing but Indian citizen who resides for long time abroad.

Therefore if you being NRI opted for General category you have done no wrong and in adversity you can challenge this action by filing writ petition in high curt.
