• Abuse and extortion

I was living with a man for 1.5 years but the relationship didn’t workout. I moved out from there and promised to share half the rent till end of lease period which is Feb 2025. Few weeks back he asked me to come to the old house else he will walk into my office so I went there reluctantly. He slapped me, banged my head against the fridge and broker my phone and called me multiple abuses. Now he says he will not move out from the house in Feb and is expecting me to pay him as long as he lives there. He writes disgusting emails to me every threatening to get me raped and ensuring me he will drain me of every single rupee I have and destroying the life of women around me. I don’t know what to do and I am scared. Please help,

You should take the following steps immediately:

  1. File a Police Complaint: Report the physical assault and threats, including emails, to the local police. This behaviour constitutes assault, harassment, and criminal intimidation under Indian law.

  2. Preserve Evidence: Save all threatening emails, messages, and any proof of assault or damage (e.g., broken phone).

  3. Apply for Protection: Seek a restraining order or protection order from the court to prevent him from contacting you or coming near you.

  4. Legal Action for Rent Issue: If he refuses to vacate the house in February 2025, consult a lawyer to address any contractual liabilities.

Act quickly to ensure your safety and legal protection.

This is fit case for approaching police as multiple offences are committed and you have electronic proof. If you don’t want to go to police, you can file criminal complaint  in the  court of Maharashtra  under Protection of Women from Domestic Violence Act, 2005. You need to be his wife to file such complaint  and it will not affect your reputation.

You cannot sit idle tolerating such humiliations.

You call your friends or people to help and rescue from this savaged person.

Alternately you can lodge a criminal complaint to local police against him.

You should not oblige to pay the rent for the period you have not stayed there.

You can issue a legal notice asking him to apologise for his beastly acts as well as for his intimidating behavior.

- As per the Supreme Court,  When a man and a woman live together as husband and wife for a long term, the law will presume that they are legally married unless proved contrary.

- Further, the Protection of Women from Domestic Violence Act 2005 provides for the protection, maintenance and right of palimony to a live-in partner, if she complains.

- Hence, if you were in relationship for 1.5 years, then you can legally take actions against him, and can also claim maintenance and residential right from him.

- You should lodge a complaint against him before the police and higher official, after mentioning all the facts in details.

- You are in liberty to lodge this complaint at any police station of India.

Dear Client,

Your safety is the priority, and you must take immediate action to protect yourself. File a detailed complaint at the nearest police station under Sections 74 (outraging the modesty of a woman), Section 351(criminal intimidation), and 115 (causing hurt) of the Bharatiya Nyaya Sanhita (BNS). The threats of rape and financial extortion also constitute criminal offenses. Preserve all evidence, including emails and messages, as proof. You can also file a complaint under the Protection of Women from Domestic Violence Act, 2005, as your past cohabitation qualifies for protection under this law. Seek a restraining order or an injunction to prevent him from contacting you further. Additionally, consult a lawyer to draft a legal notice terminating your rental responsibility post-February 2025. Do not hesitate to involve women’s helpline services or NGOs if you feel endangered. Stay strong and prioritize your safety.
