• NRI loan from ICICI bank

I am An NRI took a loan from ICICI Bank. I wanted to pay off as it didnt want the money, they gave me NRILINK which doesnt work from here. I am losing almost 1 lakh per month its been 4 months, I. mailed couple of checks to the branch they are saying signature doesnt match . I will be fying next month to resolve this but cannot I hold ICICI bank repay me. I did open a issue with them and tried informaing them several times, mailed the branch but they dont help me

1. Looks like the Bank is intentionally dilly dallying this issue to earn interest in the meantime.

2. If there is no valid reason for this delay then this action amounts to deficiency of service and for this you cans eek compensation and damages by filing case before the consumer forum.

You issue a legal notice through your advocate to branch of the bank giving details of your correspondence with the bank and instruct Bank to comply with the demand to close your account immediately failing which you can mention that the bank will be dragged to consumer forum for deficiency in service and suitable compensation besides the relief sought.

You will not get any proper response from the bank for your email correspondences neither they will bother about any number of reminders sent, this is the pattern of their work culture.

Hence you may resort to legal action by first issuing a legal notice followed by a complaint with consumer distress redressal commission against the bank which will be the remedy.

In the Present Scenario, being an NRI, and facing issues with respect to loan payment with ICICI Bank, you have made efforts to repay the loan through the NRILINK platform. However, the same does not work in your location, and as a result you mailed cheques that were rejected due to alleged signature mismatches. But the bank has failed to provide a resolution, resulting in a financial loss of ₹1 lakh per month for the past four months. This clearly constitutes a deficiency in service under the Consumer Protection Act, 2019. Additionally, under the Banking Ombudsman Scheme, 2006, you are entitled to complain on the matter for non-resolution within certain days of your complaint. However, to resolve this, you may complain on the issue to ICICI Bank’s NRI Grievance Redressal Cell, lodge a formal complaint with the Banking Ombudsman, and if required, may also file a complaint with the Consumer Dispute Redressal Forum, seeking compensation for the loss caused. Further, it is suggested that you maintain all the relevant documents and obtain written acknowledgment of your complaint.

- This is totally deficiency in services on behalf of the bank, as due to the banks fault services the loan amount could not pay off by you. 

- You can lodge a complaint before the same bank and its head office even via email.

- Further , you can send a legal notice as well for claiming damages /compensation for the loss.
