• Signed on Blank E Stamp

I had taken a solar panel connection. Few days back a person from the vendor company came to my home and told me that i have to sign an estamp as it will act as an agreement between me and my electricity provider.
He was in a hurry because the office was going to close in half and hour. So he asked me to sign on an estamp. As we were in a hurry so i didnt pay that much attention to the details present on the estamp.
He told me to sign on blank estamp and said he will quickly go and get the agreement details entered in it and will submit it in an hour.
Now he is saying that he has lost that blank estamp on which i had signed.
As we were in hurry so i forgot to take a photograph of it, what should i do?

Lodge a complaint with vendor company that his representative had come to your residence and taken  your signature on blank e stamp 

 

mention that representative now claims that he has lost r stamp and details of agreement have not been forwarded to you 

 

also lodge police complaint in this regard against representative of vendor company

You inform the company and ask them the details for this stamp paper and if they don't provide any relevant information you may issue a legal notice to them to either cancel the blank estamp paper or produce the same with the agreement as informed by the company staff failing which you can resort to further action as per law.

  1. First of all you must get an FIR lodged with the police about the whole incident describing the involvement of the agent from the vendor company. 
  2. In case you need to get another one signed, ensure you get a copy of the paper.

As stamp paper is issued electronically, you can ascertain serial number and date of issue from the  stamp vendor giving details of purchaser and party for whom it is purchased. Issue a public notice in local newspaper that such stamp paper is lost and you will not be liable for any misuse of it by any third persons.

- You should ask the said vendor to give your details of that e-stamp paper and the agreement copy 

- Further, if he refuse for the same, then you can send him a email or letter to cancel the said stamp paper and mention that you have legally not entered into contract with him.

Dear Sir,

 

you can search the e-stamp paper number online by entering your details if it was purchased by you otherwise the vendor can check the details.  You file an FIR/ loss report of the document ( e-stamp paper) mentioning the value of the amount stamped and the purpose for which it was purchased.

 

You may also have to declare on a daily newspaper that the e-stamp such signed shall be treated as cancelled for all the purposes and a copy of the same declaration alongwith an application be submitted to the registrar e-stamping to cancel the same.

If you remember the date and the kind of blank e-stamp paper then you issue a legal notice to the person who obtained it from you to return the duly signed blank  e-stamp paper immediately or to ace legal consequences through police.

Besides yo can issue a public notice through a local newspaper mentioning that so and so person obtained a signature in the blank e-stamp paper, and that if anyone indulges in any activity against your interest using this stamp paper will not be binding on you.

If the paper contains many details then it canot be considered as a blank paper. 

In that situation the person who signed the paper has to undertake the responsibility and cannot claim innocence or ignorance of the contents.

This seems to be an unregistered agreement with no terms present in the paper except the names of parties and your signature, hence it is not legally maintainable nor it is enforceable in law.

However, you may take preventive steps to first issue a legal notice to the company mentioning the irresponsible and careless acts of their staff and demand the return of the same within a time stipulated in it.

Subsequently you may issue a public notice in a local newspaper mentioning the loss of the half filled unregistered estamp paper agreement stating that the finder of the same to return it to your address and that anyone indulging in any illegal activities using the same would be dealt with as per law and no such acts are binding on you.

This step will protect your interests.

You need not panic, but act very fast to cover your interest. You need to ask from the vendor company a written confirmation that you lost the e-stamp, it is important to get it in writing. Consult a lawyer with your case and be directed on how to proceed. However, under the Consumer Protection Act of 2019, you can complain about such substandard products, if you feel blasphemed or the seller is becoming reluctant to deal with or explain. In the event of a dispute regarding the creation of the contract relating to the e-stamp Section 10 of the Indian Contract Act, 1872 may also be relevant.

- Yes, upper portion of the stamp paper having details of purchaser of the stamp and the second party with the details of the stamps. 

- You can send a notice to the said vendor to give you details of the agreement with that stamp paper, otherwise you can cancel the agreement with the vendor.
