The municipal authorities cannot change the name in the birth register until and unless there is a particular direction from court to the registrar of births and deaths.
The name in the aadhar card and pan card can be changed based on the government gazette publication by following the prescribed procedures
I went to Aadhar card and they denied saying they can not change the name saying they got a new GO.I also have a court order on name change which included mentioning the new name on it and still my application is not getting processed. What to do if the court order is not being accepted?
File writ petition in HC to direct authorities to change your name in Aadhar card on basis of court order and gazette notification
You are probably not following the proper and correct procedures.
Is there a particular order in the court divorce decree that your daughter's name can be be changed as per your proposal.
Has the court directed the authorities to change the name of your daughter in its order.?
If there is no provision to change the name in aadhar there are procedures to follow legally, i.e., by obtaining an order against the aadhar authority which denied you this permission by filing a writ petition before high court.
Did you see the GO what they refer?
The aadhar centre doing this job may not be aware of the procedure hence you cn approach the authorities directly.
Dear Client, if you have official gazette notification from the court, you can change the name of your son legally. It is illegal on part of municipal office, aadhar and passport office to reject the change of name.
Now, you have two options left with you, one is to file a petition in the court on rejection of gazette notification by public officials. And other is try to contact and explain the higher officials of these public departments to enfrce the gazetted notification on change of name.
