• To ask for my question and answer sheet from IIBF

Hi, I recently did my CAIIB exam from Indian Institute of Banking and Finance i.e. IIBF (it is a company having Corporate office in mumbai). However, in the 4th subject, I faced technical issues while submitting my answers via the computer system in exam centre being in Chennai. I have already informed the issue to the IIBF via their online grievance portal. However, I will be reverted after 3-4 days and provisional results will be released in the same time frame.

How to proceed about to get my question and answer sheet via legal notice and what is the proper court for the same.

PS - they also have a professional Development centre here in chennai

You have to register your complaint on their website following the procedures and giving the details of the grievance and nature of complaint and the relief sought.

If you feel that your concerns are not addressed properly then you may resort to legal action by first sending a legal notice demanding the relief sought after which you can plan further legal action if there is not response or cooperation.

You can file a complaint with the consumer court in India over any issues pertaining to services, including education. You may bring a complaint against the Institute for inadequacy in service resulting from technical problems during your CAIIB exam under the Consumer Protection Act, 2019 (CPPA, 2019). Indicate the kind of inconvenience you've experienced and ask to see your Q&A document. Await the institute's answer to your grievance before filing a lawsuit. If not satisfied, notify the consumer court of your intention to seek redress by sending a legal notice via a lawyer. State the pertinent provisions of the Consumer Protection Act, stressing your entitlements as a buyer. Make sure your notice specifies a fair amount of time for resolution.

You can send them a legal notice and later proceed in consumer court there are confilcting judgements for the same against educational institutions else you need to file writ petition

- Since, you was facing technical issues while submitting your answers via the computer system, hence you should inform same time for the said problems 

- However, you can send a legal notice through a lawyer to provide you details. 

- Further, if no positive response, then file a suit before the court.
