I married on 14/06/2019,Now we have a 3 years old girl child. I feel my wife is not taking good care on our child, regarding this we having lots of arguments happened, my wife family are domestic violation my child especially wife grandmother, mother and her elder sister. I feel these person have narcissistic personality disorder. They are Mentally affecting, my child because of this we have more arguments and i some time i have used bad words and even beat my wife. My wife family constantly manipulating my wife and turning her against me. The worst situations is they are harming my child but my wife is not caring about it. This Is my child Issue.
My Issue, I have personalyattacked by proliticaly infulanced Narssistic person ,for past 6 years i have trama attack. This person is my father side relative. Their main gole is to spoil my name and keep seperate form socity, so that i will be depond on them, to surviv. Now all my relative and my wife relative are joined to affecting me and my child. 

My Question Are:

Visit a family counsellor to resolve your differences 

 

2) if there is no possibility of reconciliation them file for divorce on grounds of mental cruelty 

 

3) seek joint custody of your daughter 

 

4) welfare of child is paramount consideration 

 

5) you would not get sole custody of your child

You better shift your residence away from your wife's maternal home.

Prevent your wife visiting her parents house frequently.

On her visits you prevent her from taking the child.

The child is just three years old hence her parents will be having love and affection to the child hence you first of all ascertain the harm or injuries they have done to the child after which you can take legal action as per law in this regard.

1. Looks like some sue is bothering you as relative from  both sides are not expected to cause you harm.

2. Nevertheless try to stay away from your relatives and in laws for some. 

3. Go for leisure trips more often and do not communicate with these relatives frequently.

4. Remove the thought of any case and concentrate on your child's development. Try to debate with your wife in case of disagreement instead of argument.

Things will surely be normal once again. Mediate regularly.

- If she is not giving much attention towards the daughter , then you can claim full custody after filing a suit before the family court. 

- As per the Supreme Court, for the custody of the minor, the only consideration is the welfare of the minor. 

- Under Hindu law, A mother usually gets custody of the minor child, under the age of 5 and fathers get custody of older boys, but it is not a strict rule and is primarily decided based on the child’s interests.

- The choice of a child above the age of nine is considered, and further a mother who is proven to neglect or ill-treat the child is not given custody.

- Further, to win sole physical and legal custody, you should show, the court that awarding you custody is in the best interests of your child due to factors such as your existing relationship with the child, stability of the home life you provide, inability of the mother to meet the child's needs; mother's lack of involvement in day to day need of a baby child.

- Further, if they are creating trouble then you can file a complaint against her family members for the offence of intervention in married life 

- Further, your mother can also file a complaint under the provision of DV Act against her daughter-in-law for her harassment.
