• Want to know if I am culpable in a motor accident

I was trying to make a U-Turn in my car from the left side of the road. I had my indicator blinking and also put my right hand out to signal.

Behind me was a Innova car (registered in a different state) and riding parallel to the Innova car was a lady in a scooty type bike.

On seeing my indicator and signal, the lady in the bike, instead of slowing down or stopping, rode towards the right and the Innova car also did not slow down or stop and as a result of that the Innova car hit the back of the bike and the lady fell down from the bike and her bike as a result of losing balance, hit the back of my car slightly and fell down.

The lady was wearing helmet. There was no visible head injury. There was no outward injuries since there was no bleeding etc. None of the vehicles hit her body directly. But she fell down from her bike hard and landed on her pelvis hitting the road. And as a result of that she was shouting in pain.

On seeing this, I parked my vehicle in the left side of the road, got down from the vehicle and went to the scene. There were a couple of Police Personal including a Woman Police and a Traffic Police already arrived at the scene, since this happened right in front of a Police station and in a busy place. The crowd was also gathered. The lady was already taken inside the same Innova car that hit her and the Police were asking the crowd about what happened and some in the crowd acknowledged that they saw my car about to make a U-Turn but told that the Innova car hit the bike. In the mean time the Innova car along with the lady left to the hospital. Nobody asked me anything and the crowd also slowly dispersed and everybody was back to business. Then I came home.

Now my question is, am I culpable in this accident? If somebody registers a case, will I also be included? Will the story be changed by any party so as to demand something from me (This is a very busy public place with shops and right in front of a police station. So I'm assuming there will be CCTV cameras but I'm not sure.)? Should I do anything as a precautionary measure?

Only the woman scooter-rider who was injured could complain. As long as your version is what really happened, you need not worry unnecessarily. Check if any CCTV coverage is available near the scene of the accident. In case of need, it may come to your rescue.

- Since, the said lady has not lodged any complaint on the spot to the police against you , then no need of worry , you are not responsible for the said accident.

It is very clear from the factual details that the innova had hit the lady from the back who had to fall on your vehicle since your vehicle was passing through that way.

If your vehicle was not there then she would have fell on the road directly, therefore you cannot be held liable for the accident since you are not involved in this accident at any given point of time.

Even though, you can make sure that the accident has been reported against the innova driver alone and not against you,

However if you have been impleaded as witness, you may have to appear before court when the summons sent to you.

Before that you wait and watch the developments, i.e., please wait if the lady had given any complaint against you or the other person after which you can think about challenging this case if necessary

Dear client,

Given your description, it seems like you were signaling and attempting a U-turn. However, the accident occurred due to the actions of the motorcyclist and the car behind you, not directly involving your vehicle. It's essential to cooperate if authorities reach out for your statement or as a witness. It might be wise to document the incident for your records, like taking note of the time, location, and any potential witnesses who saw the events unfold. If there are CCTV cameras in the area, they could provide crucial evidence. However, it's unlikely you'll be held directly responsible based on your account of the situation.
