• Society harassing me over being a bachelor female tenant

Hello sir, I am a railway employee living a hosing society near railway station which is convenient by distance to save my time when going to work place. The ex chairman and the secretary have been harassing me for being a batchelor as at time of agreement I had told my broker that my parents will keep coming for few days but not stay for whole time. Thats why I rented a 1bhk flat. So he mentioned my parents names in the agreement as well. My parents have to look after my grandmother aged 94yrs living in our village. My father also discussed the same thing to them but later they came with another complaint that random guys keep visiting me in night n day I asked them for cctv footage but they failed to prove. Again due lack of parking space they've made a rule that only owners will park their bikes in specific parking and tenant will park somewhere like behind security cabin or anywhere is place left. I complained to my owner about this they are living in different state and also cant deal with the hindi language.the owner's wife also told them to let me park my bike in their parking space but they said no. N still continuing with different allegations... I am suffering lot.. please tell me what should I do? My owner is ready to let me stay in the flat but this sick people I don't understand what they really want?

If the owner is not sorting it out then you will face serious problems.

If the owner is not agreeing to fight and defend your interests by first sending a legal notice  and then also if the society is not taking any action, you may better avoid all such issues and place your  your demand in the next meeting

I am sorry to hear that you are facing harassment from the ex-chairman and the secretary of your housing society for being a bachelor female tenant. I will try to provide you some information and suggestions to resolve your issue:

You possess the right to reside securely in your rented flat without interference or discrimination from society members. This includes obtaining proper receipts for rent, accessing society's common facilities, inviting guests without causing disturbance, and using the parking space allocated by your landlord. The society shouldn't impose arbitrary rules on you.

To address this issue:

  1. Open a Dialogue: Initiate a conversation with the ex-chairman and secretary. Ask for evidence supporting their claims against you, like CCTV footage. Get your landlord involved, as they hold the responsibility for your tenancy and can communicate with the society on your behalf.

  2. Legal Notice: If harassment continues, send a legal notice through a lawyer, demanding an end to their intimidating behavior and any rights violations.

  3. Police Complaint: Lodge a complaint against them under sections of the Indian Penal Code for outraging and insulting a woman's modesty, criminal intimidation, and intentional insult. If they've misused your personal data, invoke sections of the Information Technology Act.

  4. Consumer Forum: File a complaint under the Consumer Protection Act, stating their unfair practices and service deficiencies. Claim compensation for the mental distress you've endured.

  5. Cooperative Societies Complaint: Approach the registrar of cooperative societies, citing the ex-chairman and secretary's breach of society bye-laws. Request an inquiry into their behavior.

Taking these steps should help in addressing and hopefully resolving the harassment you're facing.

Ask your owner to give them letter in writing about your concern and later on still they don't listen to you and your owner. you can make complaint on behalf of your owner or on your owner's name written a complaint to sub-register of Co-operative housing Society of your ward.

- As per law, a society/RWA has no legal authority, to issue moral, ethical and social diktats to its residents.
- Further, Society by law and resolutions must be limited to the mandate of governing the society’s affairs and nothing more.

- Hence, society having no authority to restrict you to live alone on any ground  , and you can lodge a compliant against the management of the society before the Registrar and other competent authority.

- Further, you can also lodge a complaint against the erring society before the police as well.
