• Exhaustive checklist for buying a plot in Gram panchayat layout in Telangana

I am looking for a detailed checklist and a thorough process of checking documents for purchasing land in GP layout in Shamshabad(Hyderabad). Please share an exhaustive check list and what each of of the item represents and where each of the items can be found. We do still want to get a legal opinion but we need to have a thorough understanding of the process and each of the individual items.
We know that we can get an EC online and we have it.

The key legal documents in Hyderabad when buying property are:

  1. Title Deed.
  2. Conveyance / Sale Deed.
  3. Tax Receipts & Bills.
  4. 7 / 12 Extract Document.
  5. Building Plan Approval.
  6. Occupancy & Commencement Certificate.

Your preferred property should be in the name of its current seller only. Only a title deed can prove the seller’s absolute ownership over that property.

A typical sale deed usually includes all the basic details of the buyer as well as the seller. Moreover, this document is used to prove that the property’s title has been conveyed to the new buyer by the seller.

it’s essential for the seller to clear all the taxes and ensure that the local municipal corporation hasn’t issued any such penalties.

When purchasing any land in Hyderabad, the 7/12 extract document is one of the most important documents. This document involves information such as survey numbers and the current owner’s name registration date.

A building plan approval is one of the most important legal documents in Hyderabad that you should check before buying a flat. As per the RERA act, every property developer must obtain a building plan approval.

The commencement certificate and occupancy certificate are other important documents to check. A builder can obtain the Commencement Certificate issued by GHCM.

Before buying any property or flat in Hyderabad, it’s always better to take care of all the legal documents that are required for the purchase and also obtain a proper legal opinion before purchase.

A Gram panchayat layout refers to a plot arrangement approved by the Gram panchayat, the governing body in rural regions. Such layouts might not always have clearance from the Director of Town and Country Planning (DTCP) or the Urban Development Authority (UDA). Purchasing a plot in these layouts can pose risks like unclear titles or lack of amenities.

When considering a plot in a Gram panchayat layout in Telangana, here's a checklist:

  1. Title Deed Verification: Ensure the land's title deed, the main ownership document, is clear and authenticated by the sub-registrar’s office.

  2. Encumbrance Certificate (EC): This certificate shows the land's transaction history for a minimum of 30 years and should be free from any claims.

  3. Layout Approval Certificate: It certifies the plot layout's approval by the relevant authority, either Gram panchayat, DTCP, or UDA. Also, ensure RERA registration.

  4. Land Use Certificate: Ensure the land's conversion from agricultural to non-agricultural residential use, obtained from the revenue department.

  5. GO 111 Area Check: Ensure the land doesn't fall under the GO 111 area that restricts construction near Himayatsagar and Osmansagar lakes.

  6. R1 Zone Check: Verify if the land is in the R1 residential zone, which allows specific housing development parameters.

  7. Document Verification: Ensure related documents like sale agreement, mutation record, tax receipts, etc., are accurate and updated.

  8. Amenities Check: Assess basic facilities like road access, water, electricity, drainage, and confirm no pending dues on these services.

  9. Professional Help: Engage a lawyer for legal document reviews and a surveyor for accurate plot measurements.

In essence, while purchasing a plot in Telangana's Gram panchayat layout, thorough due diligence is essential to avoid potential pitfalls.

- The following doucments should be checked

1. The title deed of the present owner of the plot

2. Khata Certificate/Extract : Khata certificate or extract is an important document for the registration of a new plot. It is also required if you want to transfer the ownership of the plot at a later stage. This document is a proof that the plot has an entry in the local municipal records.

3. All the earlier ownership documents /chain

4. Possession letter

5. Property Tax Receipt

6. Encumbrance Certificate: An encumbrance certificate is required to prove that the plot does not have any outstanding legal dues or mortgages. This is one of the key documents banks ask for before they grant you a loan. This certificate also has all the details related to the past

7. 7 / 12 Extract Document.

-  These documents can be certified from the office of the Registrar , and even online
