Hi. Vodafone Idea has sent me a legal notice through an advocate of High Court Mumbai. It was incorrect charges of 4000+ INR. I told them since Aug 22 and its incorrect charges sine Aug 2022. They harassed and disrespect me and my parents since Aug-2022 till now. Yesterday, when I showed them the real scene, they identified their mistake and now telling me that they will waive off the incorrect charges. An incorrect legal notice sent across to me. I am angry and they requested me not to put on DoT website with 12+ escalations level and final escalation are Prime Minister and President of India. Spoke to senior officer of DoT and he even told me to upload my case on the portal. Please suggest. Mental harassment and daily 25+ calls with threats for incorrect charges which they accepted yesterday.

you can file complaint against vodafone before consumer forum and seek compensation for mental torture undergone by you 

 

also seek litigation costs 

 

however legal expenses would be far more than compensation awarded by consumer forum

they have accepted their mistake . if you want compensation then you have to sue them for compensation

As per Supreme Court, One is bound to tolerate criticism, dissent and discordance but not expected to tolerate defamatory attack,

- Under sections 499 and 500 of the Indian Penal Code, defamation is a criminal offence. Defamatory acts can include “words either spoken or intended to be read", signs or visible representations, which are published or put up in the public domain. The offence is punishable with up to two years imprisonment, a fine or both.

- You have a legal right to live in the society peacefully and respectfully. Law of the land is bound to protect you.

- Your mentioned details are amounts to Defamation, and a criminal case can be filed against this company.

- Hence, firstly lodge a compliant before the police and higher officials against the said acts of the officials of Vodafone.

-  Further , you can also approach the Consumer forum as well for claiming compensation of harassment.

They are scared, you may upload your grievance to DoT website. Do exactly that. You can even file a civil suit seeking damages of mental harassment from Vodafone.

You are not restricted to take legal action agaisnt the staff of the service provider for their false actions and the threats they posed so far without ascertaining the facts.

You can even approach consumer redressal commission with your grievances in the form a complaint and seek necessary relief and compensation to compensate the mental agony they caused.

This will ensure that you have a record of their admission and their commitment to rectify the mistake. You may also ask them to provide you with a copy of the legal notice that was sent to you, as it is your right to receive such a document.

If you have been subjected to mental harassment and daily threats from Vodafone Idea, then you can file a complaint with the Telecom Regulatory Authority of India (TRAI). You may also consider filing a police complaint against Vodafone Idea and the individual(s) who have been harassing you and your parents. It is important to keep a record of all the calls, messages, and other forms of communication from Vodafone Idea as evidence to support your complaint.
