Hello

You will have to get the marriage registered under the provisions of the Foreign Marriage Act.  for this one of the party will have to show residence of at least 30 days in one city and thereafter you may approach the registrar of marriage of that city to get the marriage recognized under the provisions of the Foreign Marriage Act.

If your son and his fiancée are both Indian passport holders and wish to get married in Hong Kong, their marriage will be recognized as valid in India under the Foreign Marriage Act, 1969.

Under the Foreign Marriage Act, Indian citizens who get married outside India are required to register their marriage with the Indian diplomatic or consular mission in the country where the marriage took place. After registration, the marriage certificate issued by the foreign country will be considered as proof of the marriage in India.

Therefore, if your son and his fiancée get their marriage registered with the Indian consulate or embassy in Hong Kong after their registered marriage in Hong Kong, their marriage certificate will be recognized as valid in India under the Foreign Marriage Act, 1969.

It is important to note that the specific requirements and procedures for registering a foreign marriage in India may vary depending on the individual circumstances and the particular Indian diplomatic or consular mission involved. Therefore, it is recommended that your son and his fiancée seek the advice of the Indian consulate or embassy in Hong Kong for specific guidance on registering their marriage in India.

Under the Hindu Marriage Act, marriages can be registered in India by the Registrar of Marriages or any other officer appointed by the state government under Section 8 of the Act. They can apply for a marriage registration from the Indian consulate or embassy in Hong Kong. This will enable them to prove the validity of their marriage in India.

1.    The said marriage registered in Hong Kong will not be valid in India unless they marry before the Indian Consulate at Hong Kong under Foreign Marriage Act.

2. It will be prudent on their part to register their marriage in India as per Special Marriage Act.

Dear client,

If your son and his fiancée have a registered marriage in Hong Kong, the marriage certificate will be recognized as a valid marriage in India, as per the provisions of the Hindu Marriage Act. However, they may need to get the marriage certificate apostilled or attested by the Indian Embassy in Hong Kong to ensure its validity in India. It is advisable to consult with a lawyer who specializes in family law and has experience dealing with cross-border marriages to ensure all legal requirements are met.
