• Nominee Benefits for LIC Agent

Dear Sirs/Madam ,

Greetings ,

My Name is Kannadasan Bremakumar. My Father A.BREMAKUMAR was an Insurance Agent with LIC ( Agent Code : 03886744 )Mayiladuthurai, who passed away in December 2016.I am his nominee.
Since he completed more than 5 years with LIC , I am eligible (as heir and also he appointed me as nominee as per LIC records ) for Hereditary Renewal Commisions , Gratuity , etc .
Post demise of my father , I have submitted my father's Death Certificate , Legal Heir Certificate , My Bank details , and other requisites for his agency benefits and also for the policies purchased on his name.
I have received the benefits for the policies which are purchased by him on his name, being his nominee.
Yet the LIC Agent benefits like HRC ,(Hereditary Renewal Commission , Gratuity , Group Insurance) etc are not yet received.
Despite of visiting branch for multiple times , it is of no use.
I would like to know , what should i do from now on , to ensure that I am getting the benefits.
I suspect a foul play by the Development Officer of LIC who is in charge of My Father's agency.
I have the list of policy holders under my father and respective commission bills.
Guide me , where I can file the case and how to proceed from here on for getting the benefits .
The amount owed by LIC is tiny ,yet I am aggrieved and I would like to bring the lethargic officers before the court of law .Kindly guide me on the same.

Is above case eligible for Public Litigation Interest , as I do not find any Standard Operating Procedure for settling the benefits for its own agents .

Many thanks in advance.

You issue a legal notice to the branch manager under whose jurisdiction your father served as an agent, with a copy to the marketing manager of the division office nd the senior division manager, with a copy to the Zonal manager.

You have to give the details of policy numbers for which your father was eligible for hereditary renewal commissions .

If you do not get any reply within the time stipulated in the legal notice, you may file a suit for mandatory injunction against the above said officials seeking direction to settle the claims of HRC as claimed by you, which would be arrears or future commissions in your favor.

If you  were a nominee then the commission amount will have to be settled to your name as and when one arises.

If you do not want to file injunction suit, you can opt to approach consumer forum for deficiency in service or high court with a writ petition seeking relief and remedy

If you have filed your claim with the authority concerned, first enquire about its status by sending them a registered letter- with AD. If there is no response, file an RTI application in order to ascertain the factual position. Then, depending on the outcome, send a legal notice demanding immediate redress. Proceed to file suit, if need be, at the proper court, in consultation with your lawyer.

Dear client,

I'm sorry to hear about your situation. As a nominee and legal heir, you are entitled to receive the Hereditary Renewal Commission, Gratuity, and other benefits that your father was eligible for as an LIC agent.

Firstly, you should try to resolve the matter through the LIC branch where your father was associated. You can request a meeting with the Development Officer in charge of your father's agency and present all the necessary documents to support your claim. If the officer is unresponsive or unhelpful, you can escalate the matter to higher authorities within LIC.

If you are still unable to receive a satisfactory response from LIC, you may consider filing a legal case against the Development Officer or LIC. You can approach the Consumer Forum or the Civil Court, depending on the amount of money involved in the claim. In case you suspect foul play, you can also file a complaint with the police.

As for Public Litigation Interest (PIL), it is a legal mechanism used in India to bring matters of public importance to the attention of the court. While your case may not necessarily qualify as a PIL, you can certainly seek legal assistance to pursue your claim through the appropriate legal channels.

It is advisable to seek the guidance of a lawyer who specializes in such matters to understand the legal options available to you and to represent you in court if necessary.
