I am trying to change my Name to "Ashok Emrys" from "Ashok Kumar Palanidurai", I approached an agency for the process, they are saying that I cannot change my name to "Ashok Emrys" stating only christian can have "Emrys" in their name.

They are also saying that if I want to proceed further then they want me to change my religion to "Christianity" which is absurd.

Both my kids are named with surname "Emrys" and have valid Aadhaar and birth certificate. Is there any rule or law that states that one can have name only based on their religion? if it is then what about atheist people?

nonsense . no such rule that you have to change your religion if you have to change your name

You have been wrongly guided or misled by some unscrupulous agents.

There is no such thing mandated by law that for keeping a Christian name you need to be a Christian either by birth or by conversion.

There are plenty of people born to Hindu family but having Christian leaders name as their original name itself.

You can get your name changed as per your own will and wish.

You do not have to contact any agent for this and no agent can help you legally for change of name except for guiding you with the procedures, provided they know the procedure.

Otherwise you can do it yourself by first preparing an affidavit giving the details of original name and the proposed new name, if possible the reasons that you would wish to change your name(not mandatory), then get this notarised affidavit published in two local newspapers as public notice, wait for 15 days after which you can approach government press with an application for getting the name change published in the government gazette publication by attaching the  copy of the affidavit and the newspaper publications of the public notice.

Once the gazette publication is done by the government press, you can keep the copy of the publication with your original documents and start using your new name immediately after that on all walks of your life.

Adding surname to your original name or removing a part of yor name from your original name is also termed as change of name.

There is no such rule on religion to change the name. It’s illegal. You can challenge the same in appeal or approaching court
