• Suggest the section under which case can be filed

I am having mc case and 498a case on me. 498A is dismissed and been aquittal. In mc case she is a pvt.college employee. As per AICTE records her is name is claimed as regular faculty.but in court college has given a letter stating that she is working as guest faculty. This is false. We want to file a case on her as well as college principal for cheating. suggest me section of law under which I can claim case on them with proofs from AICTE.

If you have clinching documentary evidences to prove that she is a regular faculty member   you should have produced the evidence before court and should have extracted the truth during cross examination. 

Have you cross examined the principal,  if not you can file a petition summoning the principal to court with the details about her employment including her salary slip. 

After that they cannot hide the facts.

If you have evidence that the college and your partner have made a false claim about her employment status, you may have a case of cheating against them under Section 415 of the Indian Penal Code (IPC). The section defines cheating as when someone fraudulently or dishonestly induces another person to deliver any property or to make, alter or destroy the whole or any part of a valuable security, or anything that is signed or sealed and is capable of being converted into a valuable security. In your case, the false claim of your partner's employment status could be considered as an inducement to continue with the marriage, which can be seen as a valuable security.

Additionally, you can also consider filing a case under Section 420 of the IPC for cheating and dishonestly inducing delivery of property. This section covers cases where someone cheats with the intention of deceiving someone and thereby dishonestly inducing them to deliver property.

Furthermore, if you have evidence that the college and your partner have conspired to make a false claim about her employment status, you can also consider filing a case under Section 120B of the IPC for criminal conspiracy.
