If you have paid the loan amount to the person through Cheque/DD/IMPS/NEFT and/or there's a Promissory Note or some form of acknowledgement obtained from him, then you can proceed legally against him to recover your money by filing civil/ criminal case. You can also complain to Police Station if there's any evidence of payment made by you.

If you have collected Cheque from him, then you can present the Cheque in the Bank for realisation and if it bounces, then you can legally proceed against him by invoking Under Section 138 of N.I. Act, as also civil case.
