Car cancellation policy after road tax and life tax is paid
What is the possibility of getting a vehicle cancellation after road tax and life tax is paid? Car automotive llp Dealer in Hyderabad did the Temporary registration without showing vehicle. Of course I have furnished the TR details over whatsappa and asked to proceed. Even then I tried to see the vehicle before the delivery. During the delivery date the vehicle got visible scratches on its bonnet which is post ceramic coating. Now I am not ready to take the vehicle despite temporary regd done. Please opine with a proper solution to get the downpayment and bank loan reversal. Banker is ready to take the loan cancellation request but dealer is reluctant to give cancellation consent.

You can refuse to take delivery of vehicle if it beats scratches on the bonnet

The vehicle suffer from defect and has shortcoming in quality as described under new Consumer Protection Act, 2019. You not at all bound to buy the same and on the same ground you seek refund of full advance paid with interest. Take photographs of defects showing scratches clearly, issue him lawyer's notice marking copy to Banker for information seeking refund with interest and after that file a complaint District Consumer Commission at Chandravihar Complex, Hyderabad. You will get refund with interest, compensation for mental harassment, costs of complaint and lawyer's fee.
You can send your communication in writing to the dealer communicating your decision to cancel the booking of the car for the reasons relied upon.
If the dealer is not willing to cancel the booking and not accepting the damage done to car not taken delivery yet, you may issue a legal notice to him and drag him to consumer forum for unfair trade practice and compensation therein.
Raise a written request with the RTO for cancelling the temporary registration of the vehicle owing to the defects noticed. Send a written notice to the dealer demanding cancellation of the temporary registration and immediate replacement of the vehicle with a defect-free one. Keep your banker too in the loop.
