• Details about kushki land

Hi, we are planning to buy a plot from a person for whom the plot is been assigned by society 30 years ago. We were checking how did society acquire land, it seems the land belonged to government and it was government Kushki land is what we understood from some of survey documents. But there is a sale deed with society from farmers in 1968. Does this mean government granted this land to farmers and they sold it? If yes can farmers sell this type of land? What exactly kushki land mean? What are the restrictions in transferring the property? Kindly advise.

Kushki land and is land classified as dry agricultural  land as opposed of irrigated land. There is  sale deed executed in 1968 by farmers in favouor society. Land assigned by society of your vendor in 1992. It is  not making any sense, if the land is  government land in revenue records it will remain government land. The might have been assigned to farmers by government which  they sold to society. Any land assigned to assignee can be sold after certain lock in period that too with permission of government. Check if there is any such permission only after that proceed with the deal.

Kushki land means dry land.

The kushki lands will be under government which will be used for burial ground and any other purpose.

If you are interested to purchase then you may verify the details and status of the land through the revenue records accordingly.

If the land has not been converted to NA then you may be in trouble to get it regularised at a later stage.

Hence better obtain a proper legal opinion and proceed only if recommended.

Assigned land cannot be transferred, only if such assignment is by way grant the grantee can transfer in any after lock in period. Ascertain if the land is an assignment of grant. If it is  assigned sale will be invalid.

You have to check the terms and conditions of allotment by government to farmers 

 

Sale deed executed by farmers in favour of society must be containing recitals about allotment of land to farmers , terms and conditions of sale 

 

obtain a certificate form local lawyer that title is clear and marketable

The kushki land is a dry land belonging to government and mainly used for burial grounds. 

However the sellers and the society would have managed to acquire the proeprty by some illegal means and would have got them regularised.

The society may still not term it as kushi land, but you may verify the revenue records about the status of land and also obtain a proper legal opinion from a local advocate who is well versed with the loocal laws and proceed to purchase only if it is recommended
