• Name change concern

I am facing problem in getting Passport. My company requires me to submit a passport for onboarding and I had to apply for a passport.

My educational documents have my middle name mentioned but I don't want to use that and all my legal documents (Adhaar, Voter Card, PAN etc) have my name mentioned without my middle name.

Example: As per birth certificate, 10th, 12th, Graduation certificate: Harold Kumar Das
As per Legal documents/employment records: Harold Das

I applied for passport and they put it on hold, they mentioned the name on my class 10 certificate will be used as the name for passport and my other documents would need to updated and include my middle name. (They asked to atleast update Adhaar for now)

Now my problem: I don't want to "change" the name given at my birth. I'm already being known as Harold Das and I would like for it to stay that way. I want to use Harold Das name for ALL my legal/government purposes.

Requesting you help on this. Again, I do not want to "change" my name, I just want to be known as first name and last name. The middle name is what the problem is. 

Isn't there any document/certificate I can get which mentions both Harold Kumar Das and Harold Das as the same person. I want to only use my first name and last name. I would like the passport to mention the same name as well.

You should change your Aadhar card to reflect your middle name . Then only passport would be issued to you as it ought to have same name as in school leaving certificate or birth certificate 

 

 

you can continue to use Harold Das in your employment records 

 

mere affidavit that both are one and same person would not suffice

The best way is to get the same published in the newspapers and the Gazzate of India. Gazzate of India is a valid legal document.

You can adopt change of name procedure to change your name from the name given in the school certificate to that of the desired/proposed name 

You can prepare a notarized and get it published in two local newspapers, after that apply for gazette publication.

Then with the copy of gazette publication you may apply for passport with the new name.

The affidavit of one and the same person is used to declare that two (or more) names pertain to the same person. If you have been using multiple names for yourself, but without legally changing your name, then you will be asked to submit this affidavit, to declare that you have used all those names. 

The deponent (person making the affidavit) has to draft the affidavit first and print it on a Stamp paper of State-recommended value (it may vary from state to state). Then, the deponent should sign the document in the place designated and swear before an official (can be attested by Public Notary) who has the authority to witness and validate oaths. Only after the deponent and the official, who witnessed the oath, signs the affidavit, the document is considered as legally valid and enforceable. I hope this will solve your issue.

Dear client, I am sorry to hear that but in this case you can change your ne on educational certificates as you desire. 

The procedure for changing name on educational certificates is more or less similar to the procedure of legally changing your name.

1. You shall have to execute an affidavit before the 1st Class Judicial Magistrate affirming that inadvertently your name has been mentioned in your  birth & educational  certificated as Harold  Kumar Das in place of Haroid Das which has been correctly mentioned in your legal and employment documents and that the said birth & educational  certificated  are required to be corrected mentioning your name as Harold Das.

 

2. Based on the said affidavit, you can get your birth & educational certificates reissued mentioning your name as Harold Das.

- As per law, there cannot be any modification  in the academic certificate after maximum 2 years from the date of passing the said qualification. 

- However, the legal documents like PAN  , Adhar etc. can be updated /modified upon submitting the required proofs of that name. 

- Further, you can apply for passport with that name after getting a birth certificate , or if you have a birth certificate with the old name then you can correct the same after submitting the Adhar before the birth Registrar.
