• ECS Bounce charges despite making payment

Dear Team,

I have taken personal loan from bank before 1 year, i took loan by login netbanking as one bank employee called for the same and guided me. Afterthat i wanted to update my address branch people refused to update my address. I had bought new apartment and i gave all the house registration documents at bank. Bank said within 90 days you have to submit aadhar or any other address proof once we update this address however since bank people said they do not have a person who can visit at my home for verification they will do it later. After few month i called branch again they said we can not update address i asked them to close my account. They called me in branch and gave me a form for account closure. 

Now the loan that i had taken from the same bank has ECS activated though i have made payment manually before 4 to5 days in advance from due date and sent email to bank stating that i made payment kindly update. I have received email everytime stating that payment has been updated.

From June month i started receving messages for payment when i contacted customer care they said bounce charges per month 800 and late fee is pending. I have informed them entire story i am making payment before due date why should i pay for bounce charges. I closed that account in Oct month 2021. I have not received any intimation from bank till June 2022. When i contacted customer care that time i came to know about charges. When i bought loan i received only one letter of loan.

No help from Bank Escalation team level 1 and level 2 and 3. They replied stating bounce charges.

My question is 
Why bank did not inform the customer to give alternate bank account at the time of closing account. Why bank closed the account when i have loan from the same bank. Why customer care never informed me about charges only sent email payment has been updated in system and we received your payment. Why bank did not send me letter or notice or email stating account has been closed we need other bank account. 



Can i go ahead with these point to next level legally?? How can i take action against bank.
Do i still need to pay ECS bounce charges for 11 month as i have made payment manually before due date.

Please guide me.

You don’t need to pay bounce charges as payment has been made before due date 

 

2) you should file complaint before bank ombudsman regarding bounce charges levied by bank as full payment has been made before due date 


In alternative file complaint against bank before consumer forum and seek orders to direct bank to reverse bounce charges and pay compensation for mental torture undergone  by you

You first note down all the points of grievances caused by bank in this regard.

Issue a legal notice giving the details of the loan repayment as well as the closure of your bank account and demand the bank to explain that why the cheque was presented when there was no due to be paid towards loan repayment and why bounce charges were demanded from you when there was no due to be paid by you as on the date of presentation of the post dated cheque towards loan repayment. 

You can instruct the bank either to reconcile their accounts statement and remove all the dues that are shown against your name or to face court of law for damages and compensation for mental harassment.

This legal notice to be sent through an advocate may be followed up through consumer forum if necessary arises.

Dear client,  I am sorry to hear that but in this you can obviously proceed with the given point. moreover you can reach bank Ombudsman if you want. 

Moreover, you need not to pay any ECS if you have already paid it. It just that you need to have certain evidence to substantiate your claim.
