• Foreign spouse of Indian right to work and long term visa for parent

I am a Sri Lankan highly skilled IT professional and going to marry my Indian Fiance soon. She is living in India and our marriage would take place in India. I am planning to move to India after the marriage initially on Entry visa and apply for OCI after two years. I would like to know, whether will I be able to take up an employment in India?

Further, my mother is 71 years old, due to her age and the situation in my country now, I feel it is not safe to leave her in Sri Lanka. Please kindly advise whether will it be possible for me to apply for an Entry visa or any other long term visa to my mother.

  1. You are entitled to seek work in India if you obtain Employment Visa procided…
  2. You highly skilled and/or qualified professional being appointed by employer on contract or employment basis.
  3. Being married to Indian national, you are entitled to obtain Indian citizen subsequent to staying for seven years in India and work as Indian citizen.
  4. Mother is entitled to visa on merit of  her case.
  5. You are also entitled Indian visa as dependent of spouse, but you cannot work of such visa.

There is no specific visa called Spouse visa for India. For any foreigners married to Indians, you can get an Entry visa (X) through any of the FRROs in India. This visa doesn't give you any rights to be employed or do business, but you can stay for a long term in India on this visa.

For your motehr:

A medical visa (MED Visa) is granted to a foreigner whose sole purpose is to seek medical
treatment in established/recognized/specialized hospitals/treatment centres in India. In case the foreign national desires to avail of treatment under the Indian systems of medicine, his/her case will also be considered. Hospital Authorities must share the documents issued by them e.g. medical invitation letter appointment letter etc. as per the format  Attendants/ family members of the patient coming to India for medical treatment may be granted Medical Attendant visa (MED X visa) co-terminus with the ‘Med Visa’ of the patient

An Employment visa is granted to a foreigner who is a highly skilled and/or qualified
professional. The foreign national being sponsored for an employment visa in any sector should draw a gross salary in excess of Rs. 16.25 lakhs per annum.

Foreigners employed in BPO/ ITES are not eligible for exemption from annual threshold
income limit.

Highly skilled foreign personnel being employed in the IT software and IT enabled sectors can get visa extended up to three years or term of assignment, whichever is less, with multiple entry facilities
