• Opening a new case on National Consumers Disputes Redressal Commission

While opening a new case on the above-mentioned website, I could notice that the platform seeks an affidavit of the complaint. 

And, that red asterisk on the left makes it a mandatory field. 

As such, given the genuinely problematic aspect of creating an affidavit, I would like to know, 
A) What is the difference between the National Consumer Helpline and Nation Consumer Dispute Redressal? 

B) Can self-filing a case on the Dispute Redressal platform be made in a simplistic manner? 

And, C) How effective are both the platforms for people with little or almost no legal wisdom? 
Thanks. 

P.S. Further, the incident, on which I am trying to file a new case on either of these two platforms involves a fictitious transaction on one of the trading platforms based out of India.

NCH is a project of the Union Ministry of Consumer Affairs operates under the Centre for Consumer Studies at Indian Institute Of Public Administration.The Project recognizes the need of consumers for a Telephone Helpline to deal with multitude of problems arising in their day-to-day dealings with business and service providers.

A consumer can call to seek information, advice or guidance for his queries and grievances. National Consumer Helpline supports consumers by guiding consumers in finding solutions to problems related to Products & Services :-

  • Providing information related to Companies and Regulatory Authorities.
  • Facilitating consumers in filing grievances against defaulting Service Providers
  • Empowering consumers to use available Consumer Grievances Redressal
  • Mechanisms, Educating Consumers about their Rights and Responsibilities.

2) if grievances are not resolved then you can file complaint before national consumer disputes redressal commission

 

3) The National Consumer Disputes Redressal Commission (NCDRC), India is a quasi-judicial commission in India which was set up in 1988 under the Consumer Protection Act of 1986. Its head office is in New Delh

 

4) Section 21 of Consumer Protection Act, 1986 posits that the National Consumer shall have jurisdiction:- to entertain a complaint valued more than ten  crore and also have Appellate and Revisional jurisdiction from the orders of State Commissions or the District fora as the case may be.

A) Helpline will guide you on your problem and what can be done by you to solve it. and Nation Consumer Dispute Redressal Commission is the quasi-judicial commission where they will provide redressal to your complaint like courts do.

 

B) You can file on your own. You will need to follow the procedural guidelines and study of consumer laws so that you can place your points in more legal and professional way.

 

C) Helpline will only guide you. They cannot give order. But Order Nation Consumer Dispute Redressal Commission is binding and appeal can only be made in Supreme Court.

 

D) If the accused is based out of India then Indian court will not have any jurisdiction. You will nedd to check if they have any branches or registered offices in Indian terretory.

1.  The consumer helpline is not a forum that can give a judgment or decision to your grievances for which you have approached this legal forum, whereas NCDRC is the legal forum where your grievances would be redressed.

2.  You may have to comply with the procedures noted therein 

3.   If you cannot access or do not understand the legal terms or procedures, you can either approach the office of the forum for more clarity or an advocate to assit you.
