I settled my outstanding credit card dues as per the final settlement issued by the bank 4 years back. But the bank has not closed the settlement and the amount shows as still outstanding. I have settlement documents received from the bank and my bank statement which shows transfer of funds to close the dues.
As they have not closed the dues they have been adding interest to the outstanding amount and I have been harassed by multiple people stating that they are police , legal department and threating me
Please guide how to deal with this

File complaint with bank ombudsman against coercive action taken by bank to recover alleged dues

 

2) enclose letter try from bank regarding full and final settlement 

 

3) you can also complain to RBI against the bank 

 

4) in alternative file complaint against bank before consumer forum and seek orders to direct bank to set aside demand for credit card dues 

 

5) also claim litigation costs and compensation for mental torture undergone by you

First of all clarify the particulars/details about the persons who are demanding the money

After that you can issue a legal notice to the bank with the copies of all the papers evidencing the settlement of loan and instruct the bank to close the account with a confirmation to you, failing which you can proceed with the legal action against the bank.

Write to the head office of the bank giving all documentary evidence. If there is no remedial action, prefer a complaint with the Banking Ombudsman. Also, issue the bank a legal notice threatening appropriate action if the issue is not settled within a deadline.

- Since, you have already settled the issue with the bank , then the bank is under obligation to issue NOC to you, hence you can send a notice to the bank after explaining your concern and request to issue NOC

- Further, after four years , recovery of any amount is barred by limitation , and the bank cannot recover any amount from you legally. 

- You can lodge a compliant before the police and higher official against the person who is calling you , as such calls are against the law.

Hi, First you have to lodge police complainant and thereafter you can file a complaint before the consumer court for deficiency of service and seek for compensations.

Send a legal notice to the Bank/ombudsman providing full details of your repayment and also inform the Bank that you are going to file a defamation case in the jurisdictional Court against the Bank seeking huge compensation for the mental agony and harassment caused to you by them
