• How to complain on themeforest

Case-1
I am a web developer, I have developed a script that took more than 45days to complete and I have submitted my script to sell in the digital marketplace (codecanyon.net). After 2 days I got a reply from the team that my script got rejected for no reason and I was not able to submit the script again.
I have raised a ticket to the team and explained what the effort I have been kept to develop the script, after a few days they have replied that
 “This time, unfortunately, your item was not successful. But this does not mean that we do not consider it to be useful or that it's not good; this means that this kind of item may not be what our Team is looking for at the moment based on Market needs. Sometimes this means that the item category is sufficiently filled and we are in search of other kinds of items. “
I was not satisfied with their response as they don't mention that I have to submit a script that they need. Please help me out in this case as my script should be submitted 

Meanwhile, the company is providing only 37.5% of the price which we are going to place and additionally they charge 5$ for Buyer Free

Example: if your script price is for 30$ and the user able to see it for 35$ and once the user purchase the script and he will get a credit of 37.5% of the total amount i.e 18.7 $

Case-2
I have taken a personal loan of amount 70000 from NBFC bhanix finance and investment limited. As per the EMI date, the amount has to be deducted on 5date of every month. In the last month( January) the EMI has not been detected even I have sufficient balance in my account. After a few days, I got a call from the team that my EMI has been pending and was told to clear the EMI. I have raised a request to the team why the EMI has not been deducted. Later on, I have paid the EMI. 

Recently after raising the complaint in rbi I got the reply from the company that the EMI was not initiated due to some technical reasons. But those people made too many calls to clear the EMI and sent messages every day. 
Meanwhile, in the month of Feb, I have paid the EMI but they keep calling me, and later on, I have sent the screenshot of my payment. Those two months they harassed me by making calls and sending text messages.

 How can I complain as I have already raised a complaint in RBI but there is no response. What will be the further procedure

Hi, Answer to Case-2. You have to lodge police complaint against the Bank and you can also lodge complaint before ombudsman in the RBI, they will take action against the Bank.

1. If you have entered into any contractual agreement based on certain terms and conditions, you can very well invoke the clause by which you are supposed to get the benefits what you are looking for. 

The prices quoted by you and the product/subject that you agreed to supply them is as per the agreed terms, you can very well raise the issue to the company and demand them to perform their part of contract without giving such lame or flimsy excuses. 

If their explanation is not satisfactory you may plan to initiate legal steps to get your grievances redressed in the manner known to law.

 

2. As the matter has been solved, you have two options before you, i.e., to leave the issue as it is now owing to closure or you can issue a legal notice to the bank/NBFC which is maintaining this reckless and irresponsible attitude continuously demanding explanation and compensation for harassing you without considering the status of the EMI repayment

In the first case you should send a legal notice and ask them to respond and pay th3 adequate price.

In case 2 you have been harassed unnecessarily and hence you may give a legal notice and if they do not respond then file  acase in the consumer forum immediately.

have you checked the marketplace's terms of use? does it have anything to say in the contingency you are in?

case 2 - 

this is a clear case of harassment. you have to file a police complaint against the lender for such unwarranted calls and harassment

              Legal Remedies available to defaulter in the case of harassment by recovery agents:


  • Filing a complaint at the police station:
    A proper complaint should be filed against the Bank and the recovery office. However, if the police do not file a complaint, the magistrate can be approached.
     

  • An injunction suit against the bank and recovery agents:
    A civil injunction suit with an ad-interim relief can be filed in the civil court against the bank and recovery organization. It should be possible to guarantee that bank authorities and recovery agents don't visit a person's home to recover the dues.
     

  • File an objection with the Reserve Bank of India:
    After getting a few public objections against banks and seeing a few cases recorded against the harassing recovery method, the RBI prescribed certain norms for the recovery agents in order to govern the approach towards defaulters. In this manner, if the defaulters feel undermined, they have an option to contact the organization and file a legal complaint.
     

  • Defamation suit:
    If the debt recovery depends on incorrect data that prompted the deficiency of a person's CIBIL score, they can file a defamation suit against the bank and recovery organization.
     

  • Trespass objection:
    On the off chance that the recovery agents of the Bank illegally invade someone's home without approved consent, at that point a trespass complaint can be filed against them for disregarding an individual's rights.
     

  • Extortion grievance:
    If the recovery agents forcefully recovered the money, an extortion case can be filed against.
     

  • Complaint to your Bank:
    Practically all banks have a complaint department. The client can move that department and can communicate on this matter. Generally, after recording the grievance, the client needs to wait for 30 days to tackle the matter or get an answer.
     

  • The banking ombudsman:
    On the off chance that the Bank does not address the issue/grievance, within the specified days, the banking ombudsman can be approached. RBI selects such individual as a senior authority who redresses the grievances by clients. The ombudsman should give a lawfully binding decision to call for settlement between the Bank and the client. The complaints identified with credit cards are filed with the ombudsman whose territorial jurisdiction the client's billing address is found.
