Hi My father need to give POA to sell his properties in Tamil Nadu. I need guidance and POA form so that I can fill out, notarized from here USA and get it certified from US consulates Houston USA

- Legally you can execute POA in favor of your father for selling the property and to appearing before the Registrar on your behalf in India. 

- The said POA should be notarized as per rule of US and further attested from the consulate of India. 

- There is not fixed Performa for POA , and you can get it prepared with the help of any lawyer of this website and also locally from there as well.

A power of attorney can be given without mentioning the schedule of properties but that would not entitle him to carry out the transactions with regard to the immovable properties.

Therefore it is pertinent to mention the particulars of the properties that he has been entrusted to take care in your absence on behalf of you in the power of attorney deed.

1. There is no template or form in connection with POA to fill up and get it executed and notarised/attested by the local Indian Consulate.

1. The details of your father and also the POA holder will be required for drafting the POA.

 

2. It will be advisable to execute separate POAs for each of the properties since after purchasing the property, the buyer will demand the original POA to ensure that you can not claim later on that you have not issued any POA to any body and the said sale is invalid.
