• Legal Heir Certificate

I am trying to get a Legal Heir Certificate in Maharashtra. I got the form from the local Taluk office. The form says "Varas Pramanpatra / Nominee Certificate".

Is this the correct form I should be filling for a Legal Heir Certificate ? 

The certificate is needed in Chennai for a property my father owns along with my mother's name on it. Since my father passed away I want to add my name and my sister's name to the property.

You need to obtain letters of administration from Bombay high court in respect of your deceased father share in immovable property 

 

2) legal heir certificate would not suffice 

 

3) for issue of legal heir certificate you have to file petition in high court at Bombay

Yes, that certificate is perfectly valid in Tamil Nadu too. You may produce the original, if required, for verification by the authority concerned.

The vars pramanapatra is nothing but the legal heirship certificate.  Varas means heirs.

Therefore you can obtain the same to prove the legal heirs to succeed the immovable property upon the death of the property owner.

- When a person suddenly dies intestate i.e. without leaving a WILL , then a Legal Heir Certificate is required for claiming the properties & assets of the deceased to his family members /legal heirs. 

- Since , your father died intestate , then you can apply for getting Legal heir certificate after submitting the identity and residential proofs of all the family members including death certificate of father. 

- Further , for getting this certificate there is no requirement for nominee certificate , and hence you should enquire from the office of the Taluk for the same.

A legal heirs certificate issued by the Revenue authority (Taluk Office/ Tahsildar's Office) mentions only the list of legal heirs of the deceased. It will not state the assets or property details. It is not a document transferring the title of the deceased to the legal heirs. In your case, find out from the Railway authority what are the documents required for transferring your deceased father's pension to your mother and for claiming the arrears of pension, if any, and act accordingly. In any case, the basic documents required would be the death certificate and the legal heirs certificate.
