• [Telangana] Is Form32A sufficient to buy/execute "Agreement of Sale" on behalf of a NRI?

Hello Sir,

Context:
I am a NRI, residing in USA. I am in the process of buying an apartment (under construction, delivery after 4 years) in Hyderabad, and signed "Agreement of Sale" with the seller (builder).
I would like to register the "Agreement of Sale" document.
I can't be physically present for the registration of "Agreement of Sale". Requesting my father to execute it on my behalf.

Question:
[I am the buyer & property registration in Hyderabad Telangana] ---> Is Form 32-A sufficient for my father to execute the "Agreement of Sale" document on my behalf? (OR) Should I grant GPA or SPA to my father to execute the "Agreement of Sale" document on my behalf?

As an NRI, you have to execute a specific PoA in favour of your father for signing and registering the agreement of sale on your behalf. Mere execution of Form 32 is not sufficient for the purpose.

- Since, you are out of India , then you can execute POA in favour of father or other relative in India for registering the Agreement to sell on your behalf. 

- This POA should be properly notarized as per rule of US and further attested from the consulate of India. 

- Only FORM 31 A is not sufficient.

For the purpose of registering the sale agreement or sale deed in your behalf, your father, being a POA holder, can do it on your behalf.

You may ave to execute a POA deed in his  favor duly attested by an official of the Indian Embassy or by a notary public of your country of residence, send it to your father, who in turn would adjudicate it before the concerned sub registrar in order to enable him to do further transaction on your behalf on the basis of this POA deed.

1. You shall have to execute a POA in favour of your father appending your signature on the POA before the appropriate officer of your local Indian Consulate. 

 

2. Thereafter you shall have to send the said POA to your POA holder for registering the agreement for sale for and on your behalf.
