• Want to submit written statement only for final hearing

I am respondent in a consumer court case coming up soon for final hearing at NCDRC, Delhi, through physical mode. I am in Maharashtra, an old man. Don't want to to travel hence want to get heard through video conferencing.
1. How to arrange for video conferencing?
2. If video hearing not possible, how to submit written final statement for consideration of judge.

Dear Querist

you may appoint any advocate for submission of your final written argument on or before the next date of hearing.

you may draft your written argument and signed the same and send it to your counsel who may submit the same before the Commission.

 

Video Conferencing/Hybrid mode shall be dispensed with from 15/11/2021 vide notice dated 28.10.2021

Hope you have engaged an advocate in Delhi. Physical hearings are yet to commence or being conducted on a limited scale in Delhi courts. If you are not able to attend the hearing in person owing to your age, please request your counsel to arrange for filing your final written statement through other means.

If you are respondent then you can either engage the services of an advocate or can send your written statement/reply/counter by post directly to the national commission mentioning the case number and date of hearing etc.

In the same post you can attach another application requesting hearing by virtual mode

You can send a letter to the registrar requesting a hearing with video conferencing. Toh can also send your written submissions to the court by post through registrar in the said matter

Dear client, 

1. You may file an application stating that it would be inconvenient and unsafe for you to travel right now, due to which you prefer video conferencing. A Court may either suo moto or on application of a party or a witness, direct
by a reasoned order that any person shall appear before it or give evidence or make submissions to the Court through video conference. 

2. If a video hearing is not possible, then you may write a statement taking into consideration these points:

  • What evidence do I need to prove (or disprove) the statements? How can I find the documents or witnesses?
  • What has happened since that time that might be relevant? (For example, has the other side made a partial payment on a debt owed to you? Have you mediated the case? Are there additional damages?)
  • Does the complaint tell all the key elements of the story?

1. These days , court in Delhi has started to function physically. However your presence is not mandatory in a consumer matter. 

2. You can send the written statement to the NCDRC, Delhi address by post and also email . The court is bound to receive the same from you. You can mention there for your inability to appear physically before the court.

1. There's a format or procedure to be followed in this regard. 

No doubt you can send it by post as party in person but consult a local advocate and get written statement prepared as per process of law. 

2. Alternately you can attend case in person.
