The affidavit duly attested by a notary public of that country is valid in India.

However executing the affirmation by an Indian non judicial stamp paper outside India is not valid.

Instead you can prepare the affidavit on a plain paper itself.

Execution of the affidavit on a non-judicial stamp paper applies only to residents in India to be legally valid. In your case, the affidavit has to be executed in the USA in accordance with their law, and sworn before and attested by a notary public there.

it is valid but not conclusive. It depends on the department before whom you are going to submit that affidavit.

Hello,

Yes that can be done. The process is that it will be notarized by notary public at your state at which you are residing and the stamp paper will be purchased on your name through the POA either in the name of your relative here or through the attorney.

- Since you are living abroad , then affidavit /declaration on Rs.100/- Indian stamp paper is not valid .

- You can execute an Affidavit simply on blank paper and notarized the same as per rule of US , and maximum you can attested it from the consulate of India .
