• Other party trying to sell land under litigation with me

I have come to know that the Party against whom I am in litigation with is trying to sell the land under litigation. The Khasra & Khtauni of the land is in my name since the last 35 years and before that was in my Grandfathers name who willed it to me. I am in possession of the land and am running a banquet hall on this land since the last 10 years. The litigation is on part of the land and not the whole land. The decision of the case in the SDM court was in my favor and now the appeal has been filed in the Upper Aayukt Court. 
What action can I take to stop the party from trying to sell the land ?

Seek injunction restraining defendant from trying to sell the land 

 

2) issue public notice that you are the owner of land and in possession of land and not to enter into any agreement for purchase of land

You may have to file a suit for permanent injunction against him to restrain him from interfering in your possession and enjoyment and also from alienating or encumbering the property in any manner. 

You can also file an application seeking interim injunction on the same lines.
