yes it is totally legal. BUT no permanent structure.
Hi, I have a terrace attached with my flat, exclusive. I had to put a tin shed with iron frame to stop garbage thrown from above. Is this legal? Living here for 6 years and built the shed few months back. Not closed one. Thanks, RB
Actually you should have obtained permission from housing society or the residents welfare association before constructing this temporary structure.
Even now you can obtain permission in writing about it for the reasons you rely upon so that nobody objects to this act of yours
Dear sir,
Kindly obtain a prior permission form the municipality and society and state te reasons for installing the same.
Thank You
1. If it is not a permanent construction and is a temporary shade erected to protect the terrace attached to your flat on which you have exclusive title, you can argue it to be legally valid.
2. However, it will be prudent on your part to lodge a complaint to your Society (if it is s gated community) and also the local police about the said through of garbage on the terrace attached to your flat. This will give you the ground for making the said erection of shade.
