• How to get agriculture land patta in Telangana in present scenario?

Hi Sir(s),

My father purchased 2 acres of agricultural land in a village (Warangal Dist, Telangana State) through unregistered document (Sadabainama) in 1980 and is cultivating it ever since. His name was entered in Kabzadar/Anubhavadar column as well. There are absolutely no disputes on the land either.

After the Telangana Rights in Land and Pattadar Passbooks Act, 2020 came into existence, the Kabzadar column was removed and the original Pattadar name is showing up in Dharani portal now. The pattadar passed away in 1985 and his family is settled in US. No one from Pattadar's family is in the village now. So, we can't take their help as well for registration. As Sadabainama's are not being regularized now, what are the other options for me to get the land patta/passbook on my father's name. Experts, please help!

Your father should File suit for declaration that he is absolute owner of property on account of uninterrupted, open , hostile adverse possession for over 12 years 

 

 

2) please note that un registered agreement is not admissible in evidence 

 

3) at most it can be relied upon for collateral purposes to prove possession of property

You can approach the revenue department with an application to transfer the name in the pattadhar passbook to your name from the original owner name on the basis of the documents that you possess to prove that the property was on your name and your possession and enjoyment after you had purchased it long ago. 

If the revenue department rejects your application then you can approach court with a suit for declaration of title to your name on the basis of adverse possession and documentary evidences to prove your possession with a direction to revenue department to transfer the pattadhar passbook to your name.

You need to get the declaration from the court if you can't contact the earlier pattadar or their legal heirs for registration

Through the right of adverse possession since you hold the land for more than 12years since 1980, you have the right over the land. As  your possession is uninterrupted and open adverse possession can be claimed. You can get a declaration from the court regarding the same

- As per law an unregistered document cannot be considered the title of a property. 

- Since the said agriculture land was in use and occupation of your father for the last about 30 years , and further his name was also entered in Kabzadar column as well , then on this ground your father can be considered as a legal owner of that property. 

- Your father should file Declaration suit on the ground of adverse possession before the court after showing his continuous possession in that land.
