I am a NRI and have issued a POA for matters pertaining to sale of property to my relative. Since then, my Passport has been renewed. Can the sale be executed with details as in the now "old" passport? Are there any formalities otherwise? Is the POA null and void?

POA is not null, and void merely because your passport has been renewed

Your passport has got nothing to do with your POA

The old passport will not be valid. You can mention both the details of new and old passport. Poa is valid if registered

POA will not be null and void due to the renewed passport. POA is valid as it is duly attested by the Indian consulate is valid.

The passport details which were true at the time of execution of the POA deed only shall be taken into consideration, the subsequent changes or developments, is desired to be carried out then you may have to either cancel the previous POA deed and issue a fresh deed or execute a supplementary POA referring the previous one adding the details of amendment carried out in the supplementary deed.

1. Has the details concerning you has been changed in your renewed passport? If yes, then what are the changes?

 

2. Your POA holder can still sell the said property based on the POA legally executed by you in his favour duly mentioning the said changes made in your renewed passport.

 

2. What changes you have made in your renewed passport is required to be known to advise you properly.

- If the said POA is noterized and attested from the consulate of India then it is valid and that POA holder can appear before the register on your behalf for executing the sale deed.

- However, if the said POA is given in India , then registration is mandatory 

- Further, Passport old or new will not create any problem and the number will be same in both the passport.

The PoA has nothing to do with your passport unless your details have changed in the new one. 

The PoA will remain valid unless revoked by you.
